Important: These Terms constitute an agreement between you and us (the developer), not with Apple Inc. Apple is not responsible for the App or its content. This agreement is governed by the laws of your country of residence, and Apple is not a party to this agreement.
The license for this App is granted to you and is limited to a non-transferable license to use Pokus Timer on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

You may not rent, lease, lend, sell, redistribute, or sublicense the App. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App.

We, not Apple, are solely responsible for providing any maintenance and support services with respect to the App as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Subscriptions are processed through Apple’s App Store and are subject to Apple’s Terms of Service. Pricing and billing terms are as follows:
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple ID account settings.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:
In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

All user data is stored locally on your device using Apple’s Core Data framework. We do not collect, transmit, or store personal data on our servers. For detailed information about data handling, please refer to our Privacy Policy.
Pokus Timer and all related content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services.
We warrant that the App will substantially conform to its description. This warranty is limited to the extent permitted by applicable law.
Apple disclaims all warranties with respect to the App to the maximum extent permitted by applicable law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the App purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
Pokus Timer is designed as a productivity tool and is not intended to provide medical advice or treatment. Users should consult healthcare professionals for any health-related concerns. We are not responsible for any health issues that may arise from app usage.
While we strive to provide reliable service, we do not guarantee that the App will be available at all times or that it will function without interruption or errors.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
All purchases are processed through Apple’s App Store and are subject to Apple’s refund policy. Refund requests should be directed to Apple. We do not process refunds directly.
Subscription cancellations take effect at the end of the current billing period. No partial refunds are provided for unused portions of subscription periods.
We may update the App from time to time to improve functionality, fix bugs, or add new features. Some updates may require acceptance of revised Terms of Service.
We reserve the right to modify these Terms at any time. Material changes will be notified through the App or this website. Continued use after changes constitutes acceptance of the new Terms.
These Terms remain in effect until terminated. You may terminate your use at any time by deleting the App from your device. We may terminate or suspend access to the App immediately, without prior notice, for conduct that we believe violates these Terms.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the App developer is located, without regard to conflict of law principles.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
